Terms of Service

1. Eligibility

To use RallyRally, you must:

• Be at least 13 years of age
• If aged 13-17, have verified parental or guardian consent (see Section 3)
• If aged 18 or older, have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable law
• Not have been previously banned from RallyRally

By using the App, you represent and warrant that you meet these requirements. If you are aged 13-17, your parent or guardian must review and agree to these Terms on your behalf.

2. Your Account

2.1 Account Creation

You must provide accurate, current, and complete information when creating your account. You agree to update your information to keep it accurate.

Teen Account Creation: If you are aged 13-17, your account will be created in a restricted state. You must provide a parent or guardian's email address. Your parent or guardian will be contacted to provide consent and set permissions for your account. You may not provide your own email address or the email of someone who is not your parent or guardian.

2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised access

We are not liable for any loss arising from unauthorised use of your account.

2.3 One Account Per Person

You may only maintain one active account. We may terminate duplicate accounts.

3. Teen Accounts and Parental Consent

3.1 Applicability

This section applies to users aged 13-17 ("Teen Users") and their parents or guardians. If you are a parent or guardian providing consent for a Teen User, you agree to these Terms on their behalf.

3.2 Parental Consent Required

Teen Users cannot access the full features of RallyRally without verified parental or guardian consent. Upon account creation, the teen must provide a parent or guardian's email address. We will contact the parent or guardian to request consent. Until consent is granted, the teen's access to the App is restricted.

3.3 Granular Permissions

When providing consent, the parent or guardian selects which features the Teen User may access, including:

• Browsing and uploading content
• Viewing and matching with other players
• Booking sessions independently or under parental supervision
• Profile visibility settings

These permissions can be modified or revoked at any time by the parent or guardian through a secure management link.

3.4 Supervised Mode

Parents may choose to enable supervised mode, in which the Teen User can match with other players but cannot book sessions independently. In supervised mode, the parent is responsible for arranging any bookings on behalf of the Teen User.

3.5 Parent and Guardian Responsibilities

By providing consent, the parent or guardian:

• Accepts responsibility for the Teen User's use of the App
• Agrees to monitor the Teen User's activity as they see fit
• Acknowledges that RallyRally facilitates connections but does not supervise in-person meetings (see Section 6)
• Accepts these Terms on the Teen User's behalf
• May withdraw consent at any time, which will restrict the Teen User's access

3.6 Teen User Obligations

Teen Users must:

• Provide truthful information, including their date of birth
• Provide a genuine parent or guardian's email address
• Comply with the permissions set by their parent or guardian
• Follow all other provisions of these Terms

Misrepresenting your age or providing a false parent/guardian email is a violation of these Terms and may result in account termination.

3.7 Account Termination

A Teen User's account may be terminated or restricted if:

• Their parent or guardian revokes consent
• Their parent or guardian requests account deletion
• They are found to have misrepresented their age
• They violate these Terms

Either the Teen User or their parent/guardian may delete the account at any time.

4. Using RallyRally

4.1 Purpose

RallyRally is a platform to connect tennis players for the purpose of arranging matches and games. The App facilitates introductions and bookings but does not supervise, control, or participate in actual meetings or matches.

4.2 Acceptable Use

You agree to use RallyRally only for its intended purpose and in compliance with all applicable laws. You will not:

• Provide false or misleading information
• Impersonate another person or misrepresent your identity
• Use the App if you are under 13
• Use the App if you are aged 13-17 without valid parental or guardian consent
• Harass, abuse, threaten, or intimidate other users
• Post content that is offensive, discriminatory, hateful, or sexually explicit
• Spam, solicit, or advertise products or services
• Use the App for any unlawful purpose
• Attempt to gain unauthorised access to the App or its systems
• Scrape, copy, or extract data from the App
• Interfere with the App's operation or other users' enjoyment
• Use automated systems or bots to access the App

4.3 Community Guidelines

RallyRally is a community of tennis players. We expect all users to:

• Be respectful and courteous to other players
• Honour bookings you have confirmed (or cancel with reasonable notice)
• Provide honest ratings and feedback
• Represent your tennis ability accurately
• Report any concerning behaviour to us

5. Content

5.1 Your Content

You retain ownership of content you upload (photos, videos, text). By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content within the App for the purpose of operating the service.

This licence ends when you delete your content or account, except where your content has been shared with others and they have not deleted it.

5.2 Content Standards

Your content must:

• Be tennis-related (for videos)
• Be your own or you have rights to share it
• Not infringe any third party's intellectual property rights
• Not contain nudity, violence, or offensive material
• Not include personal information of others without their consent

5.3 Content Moderation

We may (but are not obligated to) review, remove, or disable access to any content that violates these Terms. We may do so without notice.

6. Interactions with Other Users

6.1 Your Responsibility

You acknowledge and agree that:

• We do not screen, vet, or conduct background checks on users
• We do not verify users' identities, tennis abilities, or information they provide
• We do not supervise meetings, matches, or any interactions between users
• You meet and interact with other users entirely at your own risk
• You are responsible for taking appropriate precautions when meeting other users

6.2 Safety Recommendations

We recommend that you:

• Meet in public places (such as public tennis courts or clubs)
• Tell someone where you are going and who you are meeting
• Trust your instincts - if something feels wrong, leave
• Do not share financial information with other users
• Report any concerning behaviour to us

6.3 Additional Protections for Teen Users

Parents and guardians of Teen Users should be aware that:

• RallyRally does not conduct background checks on any users, including adults that teens may interact with
• Parents should exercise appropriate supervision over their teen's use of the App
• Parents may restrict their teen's ability to match and book independently via parental permissions
• We strongly recommend that Teen Users only meet other players at established tennis clubs or facilities, and that parents are aware of all planned meetings
• Any concerns about a user's behaviour towards a Teen User should be reported to us immediately at [email protected]

6.4 Disputes Between Users

We are not a party to any disputes between users. You agree to release us from any claims, demands, or damages arising from disputes with other users.

7. Bookings and Cancellations

When you book a match through RallyRally:

• You are making a commitment to another user
• Frequent cancellations may affect your reputation and standing
• You are responsible for any court booking fees or costs you incur separately
• We do not handle payments between users for court bookings

8. RallyRally Premium

8.1 Subscription Services

RallyRally offers optional premium subscription services ("RallyRally Premium") that provide access to enhanced features. Premium subscriptions are available through:

• Apple App Store (for iOS devices)
• Google Play Store (for Android devices)
• Our website (via Stripe)

8.2 Pricing and Billing

Subscription pricing is displayed at the time of purchase and may vary by region. All prices are inclusive of applicable taxes unless otherwise stated. By subscribing, you authorise us (or our payment processors) to charge your chosen payment method for the subscription fees at the start of each billing period.

8.3 Auto-Renewal

You can manage your subscription and turn off auto-renewal at any time:

• iOS: Through your Apple ID settings in the App Store
• Android: Through your Google Play Store subscription settings
• Web: Through your account settings in the App or by contacting us

8.4 Cancellation

You may cancel your subscription at any time. Upon cancellation:

• You will retain access to premium features until the end of your current billing period
• Your subscription will not renew for subsequent periods
• No partial refunds are provided for unused portions of a billing period

8.5 Refunds

Refund policies depend on how you purchased your subscription:

• App Store/Google Play purchases: Refunds are handled by Apple or Google according to their respective refund policies. Contact Apple or Google directly for refund requests.
• Web purchases (Stripe): Refund requests may be submitted to [email protected] within 14 days of purchase. Refunds are provided at our discretion and generally only for technical issues preventing use of the service.

8.6 Free Trials

We may offer free trial periods for RallyRally Premium. At the end of a free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. We will notify you before your trial ends.

8.7 Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of your next billing period following notice of the change. If you do not agree with a price change, you may cancel your subscription before the change takes effect.

8.8 Subscription Lapse

If your subscription lapses (due to cancellation, non-payment, or otherwise):

• Your access to premium features will end
• Your account will revert to free tier access
• Your profile, matches, messages, and other account data will be retained
• You may resubscribe at any time to regain access to premium features

9. Intellectual Property

The App, including its design, features, code, and branding, is owned by RallyRally and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our written permission.

10. Disclaimer of Warranties

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of any content
• Warranties regarding the conduct, identity, or representations of any user

11. Limitation of Liability

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim, or NZD $100, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless RallyRally and its operators from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your content
• Your interactions with other users

13. Termination

13.1 By You

You may delete your account at any time through the App settings. Upon deletion, your data will be removed as described in our Privacy Policy.

13.2 By Us

We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons may include (but are not limited to):

• Violation of these Terms
• Conduct that we determine is harmful to other users or the App
• Requests from law enforcement
• Extended periods of inactivity
• Technical or security issues

13.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive termination.

13.4 Premium Subscriptions and Termination

If you have an active RallyRally Premium subscription at the time of termination:

• If you terminate your account voluntarily, you forfeit any remaining subscription time and no refund will be provided
• If we terminate your account for violation of these Terms, no refund will be provided
• You remain responsible for cancelling your subscription through Apple, Google, or Stripe to prevent future charges

14. Modifications to the App and Terms

14.1 App Changes

We may modify, suspend, or discontinue any part of the App at any time without notice. We are not liable for any modification, suspension, or discontinuation.

14.2 Terms Changes

We may update these Terms from time to time. We will notify you of material changes by email or through the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. Dispute Resolution

15.1 Informal Resolution

Before initiating any formal proceedings, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

15.2 Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law principles.

15.3 Jurisdiction

Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of New Zealand.

15.4 Class Action Waiver

To the extent permitted by law, you agree that any disputes will be resolved on an individual basis, and you waive any right to participate in a class action or class-wide arbitration.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RallyRally regarding the App.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights under them. We may assign our rights and obligations without restriction.
